Today, I’d like to tell you about an obscure Indiana law that can block the insurance coverage for a motorcycle passenger under the biker’s policy in the case of an accident.

What The Law Says

It’s called “Indiana’s Guest Statute.” That law says that if the motorcyclist’s passenger is related to the biker, there won’t be covered for the passenger under the biker’s policy. At least not unless a very particular set of exceptions can be found.

Who counts as a “guest”

This includes cases where the passenger is the parent, the spouse, the child or step-child, or sibling of the biker. So if the motorcycle is involved in an accident, the biker’s policy may not cover the passenger.

What You Must Do

This means that you must be aware of this special risk before you take a loved one for a ride on your bike or before you get on a loved one’s motorcycle as a passenger. There might not be covered under your policy in the case of an accident.
