Two Things Needed To Prove Your Injury Claim

I have represented bikers in Indiana for over 25 years. And today, I want to talk about the two things you must prove if you’re involved in a motorcycle collision. Those two things are liability and damages.

Liability

Liability is simply who is responsible for the collision. While that sounds simple enough, it’s actually a very complicated concept. Some insurance adjusters will try to tell you that Indiana law says that you assumed the risk of injury simply by getting on your bike and going for a ride.

That’s hogwash, and nothing is further from the truth. Don’t let them get away with that.

Damages

On the side of damages, you have to prove that any of your injuries and any damages to your bike that were sustained in the collision were actually caused by the collision itself. Again, this is a simple notion but it can become very complicated.

What Insurance Companies Do

The involved Insurance companies typically hire medical experts and nurse practitioners to review your file. They’re trying to come up with any excuse to say that they’re not responsible for the treatment for your injuries.
